General Terms and Conditions

Scope

These General Terms and Conditions (hereinafter referred to as “the T&Cs”) apply to all purchases and the use of services via www.lunch-check.ch. By sending in your digital data to us or by clicking in the box designated “I accept / Accept” (or similarly) in our order software, you are stating that you agree to our Terms and Conditions below.

The products and services published online only apply for as long as they are visible on the website and while stocks last. The images shown on the website are for illustration purposes only and are not binding. The information and explanations in catalogues and on information sheets are provided for clarification purposes only and are not binding.

SLC declines all responsibility for any errors or inaccuracies in connection with the aforementioned images, diagrams, explanations, etc. in the catalogues and information sheets referred to.

Terms and conditions of the Customer that are contrary to or deviate from these T&Cs will not be recognised unless SLC has explicitly agreed to their application in writing. The current, binding version of the T&Cs is published at www.lunch-check.ch/en/gtc.

Data privacy

SLC complies with the applicable statutory data privacy provisions. Upon conclusion of the contract, the Customer grants SLC the right to use data collected during the performance of the contract for internal market research and marketing purposes. Our partners will delete customers’ personal data as soon as it is no longer needed and at the latest after the expiry of the statutory maximum retention period. All personal data is treated with strict confidentiality. The Customer has the right to view the data saved about him or her at any time and/or to prohibit its use for internal market research and/or marketing purposes. This can be done via SLC’s main address or via the e-mail address info@lunch-check.ch. The Customer acknowledges that orders can only be processed without delays if correct (and in particular up-to-date) and complete customer data is available.

Ordering and contract conclusion

A minimum limit of CHF 50.00 per gift card must be complied with. Please contact the SLC office for orders with smaller gift card amounts. The maximum balance per card is CHF 3,000.00. Orders that lead to this figure being exceeded will not be accepted. Orders are binding for the Customer. The contract is concluded when SLC accepts the order by executing it. SLC reserves the right to cancel or suspend an order if the Customer is not creditworthy or if there is justified suspicion of fraudulent intent.

As soon as our laboratory receives your digital images for an individual gift card, the job order is carried out in accordance with your instructions. Please note that digital orders, once received by us, cannot be amended, deleted or combined. Insofar as, while processing your orders, pictured contents appears which in evidence infringes the law, your order will not be processed.

Payment method

The only payment methods accepted are prepayment or credit card (Visa, MasterCard or Postcard (Postfinance)).

Delivery

Delivery is only possible in the territory of Switzerland and Liechtenstein. Deliveries in Switzerland generally take place via A-Post, A-Post Plus or – for higher merchandise values – by registered mail. Once SLC has confirmed the order, the items will be delivered to the address that the Customer indicated on the order.

Delivery time

SLC endeavours to process orders on time, but does not accept any liability in respect thereof. The following delivery periods apply as a general rule: dispatch within one to two working days by A-Post, A-Post Plus (A+) or registered mail. For orders that are required quickly, it is advisable to purchase the desired item directly in a shop. If an order is still outstanding after five working days, the Customer is requested to inform SLC of this.

Refusal of delivery

If delivery of the supplied items is refused without justification, the costs incurred by SLC will be charged to the Customer, in addition to the purchase price.

Guarantee/complaints

The benefit and risk are transferred to the Customer upon handover/dispatch from SLC’s head office. The Customer is obliged to check the items immediately upon receipt and report any damage or deviations to SLC within three working days. Otherwise, the delivery shall be deemed to have been approved. The Customer must provide proof of any incorrect delivery. He or she must return the items by the same delivery method (A-Post, A-Post Plus or registered mail) with which they were dispatched and include a copy of the online order and the credit card charge. The costs of returning the items shall be borne by the Customer. A card will only be replaced free of charge if it has a technical material defect for which the Customer is not responsible.

Liability

Compensation claims, in particular due to late delivery, are excluded to the extent permitted by law. SLC’s liability is limited in all cases to loss or damage it caused by deliberate intent or gross negligence. SLC is not liable for consequential loss or damage, in particular lost profits, or for third-party services. The SLC website site contains links to third-party websites. SLC is not liable for the content of third-party websites or for loss or damage incurred by the Customer as a result of accessing third-party websites. Any consultation of third-party websites shall be exclusively at the risk and for the benefit of the Customer.

Third-party rights

You are solely responsible for ensuring that you are entitled to the required copyright, trademark, privacy and other rights to the pictures you send in. Should any third parties assert any claims against SLC in connection with your order on the grounds of an infringement of such rights, you will be liable to ward off these claims at your expense and to indemnify SLC for
damages incurred.

Applicable law and jurisdiction

The contract and the information in these T&Cs are governed by and construed in accordance with Swiss law, to the exclusion of any provisions governing conflicts of law and the provisions of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising in connection with this contract/the information in these T&Cs is the registered office of SLC.

Reimbursement/validity

Any remaining amount on the card cannot be paid out in cash, exchanged for vouchers or transferred to a credit card. The gift cards are transferable. All commercial trade with purchased cards is prohibited.

Acceptance points

Card balances are accepted as a payment method by the partners listed on the website www.lunch-check.ch. SLC may change the list of acceptance points at any time. The Customer shall not be entitled to assert any claims as a result of such changes.

Reloading

The cards are reloadable and can be reloaded at any time at www.lunch-check.ch.
